Austrian Data Protection Authority Ruling On The Right To Obtain A Copy (Art 15 Para 3 Gdpr)

Art 15 GDPR does not only enable the data subject to obtain information on the content of his/her data undergoing processing, but also provides for a right to obtain a copy of the respective data. In August 2020, the Austrian data protection authority issued an interesting decision addressing the content and scope of this right (10th August 2020, Case No. 2020-0.204.456).

Switzerland’s Data Protection Landscape post Schrems II and Brexit

On 25th of September 2020, the Swiss parliament has adapted the Federal Act on Data Protection (FADP). However, the FADP - which aims to be the little brother of the GDPR - will only come into force once the corresponding ordinance has been drafted and passed the consultation process and its adoption by the Federal Council. The first is expected at the end of the first quarter of 2021, the latter during summer, so that the new law will at the earliest come into force in the beginning of 2022.

On 17 December 2020, the Romanian Data Protection Authority (ANSPDCP) has published on its website a new administrative sanction in amount of EUR 100,000 against Banca Transilvania, a Romanian bank, grounded on the failure of the controller to observe the principle of integrity and confidentiality of personal data and to implement adequate technical and organizational measures in order to secure the processed data.
